MARCO BEACH & BABY RENTAL AGREEMENT AND LIABILITY WAIVER
Introduction: This Rental Agreement and Liability Waiver ("Agreement") is entered into between Marco Beach & Baby ("Company") and the undersigned renter ("Renter"). The Company agrees to rent to the Renter, and the Renter agrees to rent from the Company, the equipment listed herein, subject to all terms and conditions set forth in this Agreement.
Definitions:
"Renter" refers to the person who is entering into this Agreement and renting the equipment.
"Equipment" refers to all items rented by the Renter, including but not limited to baby supplies and beach equipment.
"Rental Period" refers to the term for which the equipment is rented, as specified in the rental order.
Rental Terms and Conditions:
Equipment Rental: The Renter agrees to rent the Equipment outlined at the time of the reservation.
Rental Period: The Rental Period begins at the time specified in the rental order and concludes at the end of the term indicated.
Payment and Fees: Payment for the Rental Period and any associated fees are due at the time of reservation. The Renter agrees to pay all charges related to the rental.
Cancellation Policy: Full refunds are provided for cancellations made more than 24 hours before the start of the Rental Period. Cancellations within 24 hours of the start time are non-refundable. Reservations made within 24 hours of the start time are also non-refundable.
Use of Equipment: The Equipment must be used in accordance with all applicable laws and regulations, and in a manner that does not endanger any person or property. Baby equipment must be used as per manufacturer's instructions and with due care for the child's safety.
Safety and Instructions: The Company will provide instructions on the correct setup and use of the Equipment. Safety equipment must be used as directed. The Renter assumes all responsibility for ensuring that the Equipment is used in a safe manner.
Liability and Damage: The Renter is responsible for any damage to, loss of, or theft of the rented Equipment during the Rental Period. Any damages or issues with the Equipment must be reported to the Company immediately.
Indemnification and Waiver: The Renter agrees to indemnify, defend, and hold harmless Marco Beach & Baby, its owners, employees, agents, affiliates, successors, and assigns ("Company Parties") from and against any and all liabilities, claims, damages, expenses (including legal fees), and losses arising out of, or as a result of, the rental or use of the Equipment by the Renter or any other person. This indemnification includes claims due to the negligence of any of the Company Parties and claims arising from injuries, death, or damages to third parties. The Renter further releases and waives any claims against the Company Parties for any injuries, death, or damages to personal property that may occur during the Rental Period, except for those caused by the gross negligence or willful misconduct of the Company Parties.
Maintenance and Return: The Renter shall maintain the Equipment in good condition and shall return it in the same condition as it was at the beginning of the Rental Period, ordinary wear and tear excepted.
Dispute Resolution: Any disputes under this Agreement shall be resolved through mediation, and if mediation is unsuccessful, through binding arbitration in the jurisdiction where the Company operates.
Renter Acknowledgment: I have read, understand, and agree to the terms and conditions of this Rental Agreement and Liability Waiver. I acknowledge this agreement includes a release of liability and a waiver of legal rights, and I voluntarily agree to its terms.
